Trademark classes comprise 45 standardized categories under the Nice Classification system, a global framework administered by the World Intellectual Property Organization (WIPO) ©, and are adopted by more than 120 countries, including the United States. The classes separate goods (Classes 1–34) from services (Classes 35–45). When applying for a trademark, you must categorize your goods and/or services into one or more classes, and accurately describe your offerings. A trademark may cover a single class or multiple classes. To prevent brand confusion, your mark should not resemble any other mark in the same class(es). If confusion is highly likely, even with a mark in different classes, the USPTO may refuse registration, and other mark owners may file oppositions or litigate.
An accurate preliminary trademark search for conflicts (for the likelihood of confusion), and the ultimate filing of a trademark application, hinges on aligning your goods/services with their appropriate class(es). To determine which classes your goods and/or services belong in, make a list of specific and general keywords associated with your industry and products/services, and search the classes and their respective ID Manuals below.
