Knockout vs. clearance
A knockout search answers a narrow question: is there an obvious blocker on the register? Clearance asks the broader question counsel actually needs: would a reasonable competitor or examiner see a problem in our market?
Those are not the same job. Conflating them creates a false sense of security.
What gets missed
Register-only workflows routinely miss:
- Regional operators with senior common-law use
- Related goods sold through overlapping channels
- TTAB history that telegraphs how an examiner will react
- Domain and web presence that shapes consumer impression
